The adoption of implementing acts for the implementation of public-private partnership projects

According to the Law on Public-Private Partnerships in the Sarajevo Canton, adopted at the end of last year, the Ministry of Economy of the Sarajevo Canton has issued Regulations on the planning of potential PPP projects, establishment, and management of the PPP Contract Registry.

The Regulations provide detailed guidelines for planning potential PPP projects in the Sarajevo Canton, as well as for establishing and managing the PPP Contract Registry, as prescribed by the Law on Public-Private Partnerships. It clearly defines the meaning of specific terms and expressions, responsibilities for planning potential PPP projects, and the method for conducting analyses on the potential for establishing PPPs. Medium-term planning of potential PPP projects and the creation of an Annual Plan of potential PPP projects are envisaged.

The proposal for the medium-term and annual plan of potential PPP projects is adopted by the Government of the Sarajevo Canton, City, or Municipal Council, after which the Ministry compiles a Catalog of plans of potential PPP projects, which is used to attract investors or partners for projects.

Furthermore, the regulations provide for the establishment and management of the PPP Contract Registry, which will be established and maintained by the Ministry, with the public partner providing all necessary data to the Ministry within 15 days from the conclusion of the contract.

For transparency purposes, the regulations define public data that will be accessible to the public and published on the Ministry’s website, including basic information about the public and private partners, the start and end dates of the PPP contract, the subject and purpose of the contract, and the project implementation location.

“The implementation of the Law is ahead of us, and the final establishment of the first public-private partnership in the Sarajevo Canton will pave the way for the implementation of many other projects that will significantly contribute to improving the overall image of the Sarajevo Canton,” stated the Ministry.
